Members of the Missouri General Assembly are seeking to enact legislation that would nullify unconstitutional any federal “red flag” firearm confiscation laws or orders.

House Bill No. 1651 (HB 1651) and Senate Bill No. 1004 (SB 1004) are titled the “Anti-Red Flag Gun Seizure Act,” are respectively sponsored by Representative Mazzie Christiansen (R-Hamilton) and Senator Bill Eigel (R-Weldon Spring). If enacted, these bills would nullify any federal “red flag” laws or orders.

The proposed bill text states, in part:

3. Any federal order of protection, other judicial order issued by a federal court, or federal executive order that is a red flag law or otherwise directs the confiscation of any firearm, firearm accessory, or ammunition from any law-abiding citizen within the borders of this state shall not be enforced in this state by any state agency, political subdivision, or state or local law enforcement agency.

4. No state agency, political subdivision, or state or local law enforcement agency shall receive any federal moneys for the purpose of enforcing any federal statute, federal rule, federal executive order, or federal judicial order or findings, or for the purpose of enforcing any state statute, state rule, state executive order, or state judicial order or findings, that would have the effect of enforcing a red flag law against a Missouri citizen.

If enacted, HB 1651 and SB 1004 would be major steps toward nullifying unconstitutional federal actions and preventing Americans’ liberties from being infringed. Additionally, they are excellent applications of Article VI of the U.S. Constitution, which states “[t]his Constitution, and the Laws of the United States which shall be made in Pursuance thereof … shall be the supreme Law of the Land.”

Since the various forms of infringement outlined in these bills violate the U.S. Constitution, they cannot be considered “made in Pursuance thereof” and, thus, are not “the supreme Law of the Land.” Unfortunately, in the last several decades, thousands of unconstitutional laws on the federal, state, and even local levels have been created and enforced.

Because of this, it is imperative that officials at all levels of government push back against this lawless regime and robustly enforce the Constitution and only those laws “made in Pursuance thereof.” The above bills are excellent models for other states to follow.

Urge your state representative and senator to support HB 1651 and SB 1004 and to push back against all other unconstitutional gun control laws or measures at every level of government.
